  1. Why does each heir need to claim their share of the property individually?

    The Wisconsin Department of Revenue is required by law to distribute funds based on the intentions of the will or according to heirship. This means we cannot pay one heir the entire amount and allow that heir to distribute the property amongst the other heirs. However, it is possible to submit supplemental forms (Transfer by Affidavit or Release by Heir) which will allow one individual to claim the entire amount and distribute the funds.

    NOTE: This person, who accepts all the funds, may be responsible for any income tax liability on the funds.

  2. Can I photocopy one claim form for several heirs?

    No. Each heir needs their own claim form with a unique claim number. You can print a claim form from our website or contact us for assistance.

  3. Does each heir need to submit all the required documents?

    No. If one heir submits the will or Declaration of Heirship, the other heirs don't need to submit those documents. Make note of which heir submitted those documents so we can efficiently process each claim. Each heir is required to provide:

    • A date of birth
    • Driver's license or government issued ID
    • Proof of social security number
    • Proof of current residence
